Durable Power of Attorney (DPOA / POA)

A Durable Power of Attorney is a document that grants a specific person (the agent) the ability to act on behalf of the principal (person granting the authority to the agent). Durable indicates that it has provisions to ensure that the abilities of the agent persist even if the principal becomes incapacitated. Powers of the agent can be limited or general in scope or even customized for specific instances according to the principal’s wishes. These documents must be executed in accordance with Florida law to be enforceable.
