Pre-litigation – Prior to filing suit, there are a number of tools and approaches that can be utilized by either party to avoid a costly lawsuit. This can include evidence review and requests, demand letters, voluntary mediation, and other forms of communication or negotiation to try to resolve the matter between parties. Resolutions can take the form of Settlement Agreements, Release of Liability, or other types of agreements that help ensure our client’s rights and interests are protected. Post-Filing Litigation – Once a suit is filed, litigation of the suit begins. This is a detailed process subject to the Florida Rules of Civil Procedure. It determines how discovery of evidence is conducted, rules regarding filing of motions, response times to the original complaint, and many other detailed procedures. The length of litigation of a case can vary greatly depending on if it is a small claims, county court, or civil court case. Small claims can sometimes be resolved in as quickly as six months or less while circuit court cases can easily take one to three years, sometimes more.
